Event Terms & Conditions
Kelsey Publishing Ltd will be referred to as the ‘Event Organiser’s’ and/or ‘Kelsey’ throughout the following.
Kelsey Publishing Limited, a company registered in England and Wales under company number 2387149 and whose registered address is at Downs Court, Yalding Hill, Yalding, Kent, ME18 6AL and with registered VAT number 523 7157 54. Kelsey is organising the Event.
THE COMPLETE TICKET FOR THE RELEVANT DAY MUST BE PRESENTED TO GAIN EVENT ENTRY. ENTRY WILL BE DENIED SHOULD ANY PART OF THE TICKET NOT BE PRESENTED OR BECOME DETACHED. THE PURCHASE OF A TICKET TO GAIN ENTRY INTO AN EVENT PUT ON BY KELSEY PUBLISHING LIMITED CONSTITUTES ACCEPTANCE OF THE FOLLOWING TERMS AND CONDITIONS PURSUANT TO WHICH KELSEY PUBLISHING LIMITED IS PREPARED TO GRANT ENTRY TO THE VENUE AND THE EVENT.
Kelsey Publishing Ltd reserves the right to amend the terms and conditions at any time where it has a valid reason to do so (including, without limitation, a change in the security or public safety requirements of the Venue).
1.0 TICKETS AND ADMISSION
1.1 All tickets are non-transferable. Tickets must only be used for personal or private use. If the ticket is resold or transferred for profit or for commercial benefit or gain or as part of any hospitality package or similar arrangement by anyone without Kelsey Publishing Ltd’s authority it will become void and the holder may be refused entry to or ejected from the Event and/or the Venue.
1.2 Up to two child tickets are available for children aged 14 years and under with each paying adult. The Event Organiser’s reserve the right to require photographic evidence of proof of age should they feel it is necessary. Children must always be accompanied by an adult.
1.3 The Event Organisers reserve the right to refuse admission and to remove persons from the event who do not comply with the event rules or these terms and conditions, who represents a security risk, nuisance or annoyance to the staging of the Event or who have in his or her possession prohibited items, which shall include but not be limited to alcoholic beverages, illegal drugs, chemicals of any kind, glass bottles, barbeques, ladders, laser pens, weapons or any offensive materials in whatever format. The Event Organisers further reserve the right to conduct security searches of persons and their belongings to ensure the safety of persons at the Event. Pass-outs and re-admissions into the event shall be granted at the Event Organiser’s discretion. Re-admission shall only be possible if a valid official pass-out is presented.
1.4 Tickets will be dispatched to general admission ticket holders immediately after payment has been processed via E-mail. Kelsey will not be liable for lost tickets. Tickets for club members will be dispatched by E-mail no later than two days before the event.
1.5 Each person entering the event by general admission or within a vehicle must be in possession of a valid entry ticket. Any person not in possession of an advance entry ticket must purchase a ticket at the then advertised price or will otherwise be refused entry to the Event.
1.6 All tickets purchased are non-refundable.
1.7 No animals (with the exception of registered assistance dogs) are permitted into our the event unless stated otherwise on the website.
1.8 Please keep your ticket safe and in good condition as a duplicate ticket will not be issued if it is lost or stolen. A defaced or illegible ticket may become invalidated. Kelsey Publishing Ltd will not be liable for any lost or stolen tickets and are not obliged to re-issue such lost or stolen tickets.
2.0 TRACK DAY EVENTS
2.1 This Condition 2.0 shall apply where the Event includes a “track day” (Track Day), whether organised by Kelsey or the Event organiser. Separate terms and conditions and rules will also apply, and Kelsey will provide, or will procure that these are provided upon booking your track time.
2.2 All drivers taking part at the Track Day must:
2.2.1 produce a full (not provisional) and valid UK driving licence (or the equivalent foreign licence) along with the counterpart which can be found online with the appropriate category clearly indicated, before participating, and shall not be entitled to a refund by Kelsey if they fail to produce the requisite licence;
2.2.2 hold appropriate insurance for their participation in the Track Day.
2.3 If a Track Day session is stopped at any point, cancelled or a driver is removed for any reason for which Kelsey is not at fault, Kelsey shall not be required to refund the person affected.
2.4 All drivers and passengers participating in the Track Day Event, including spectators, are aware of the risks and that they are aware they attend and participate at their own risk.
2.5 Neither Kelsey nor any of their representatives shall be responsible for any loss, damage or injury to persons or property caused or sustained by any person as result of attendance or participation at a Track Day, save for liability for death or personal injury arising from Kelsey’s negligence or for fraudulent misrepresentation.
3.0 DATA PROTECTION
3.1 For the purposes of this Condition 12 all personal data will be looked after in accordance with General Data Protection Regulations (GDPR) as detailed in Kelsey’s privacy policy. Please refer to our full policy at https://www.kelsey.co.uk/privacy-policy/ , with particular reference to the section 1 and 2 – Business Contact Information and Customers / Prospects.
3.2 All exhibitors and contractors shall comply with the General Data Protection Regulations (GDPR).
4.0 DISPLAY VEHICLES
4.1 All vehicles to be displayed within the event must have a vehicle pass and must be placed within the confines allocated space. Vehicles displayed outside the allocated will have to be moved by the Event Organisers to either the confines of the allocated space or to the official car park.
4.2 All drivers of display vehicles will each require a car pass and a ticket.
4.2 Vehicle passes are non-transferable unless the Event Organisers are notified, and the vehicle details are updated in advance.
5.0 EVENT ACTIVITES
5.1 Motor racing is dangerous and noisy and ticket holders acknowledge that they may be exposed to possible risk of physical harm due to the nature of the Event. Kelsey Publishing Ltd and their contractors are not responsible for any loss or damage howsoever caused to ticket holders, to the maximum extent permitted by law.
5.2 During the Event the noise level may be very loud within the Venue. Ticket holders are advised to wear hearing protection during races and live concerts (if any) to reduce the risk of hearing damage.
5.3 All persons entering the event’s shall co-operate by complying with venue rules and guidelines by stewards, marshals, safety personnel and other legally authorised persons. This includes producing a valid entry ticket upon request, submitting to inspections and allowing removal of unauthorised objects.
5.4 Photographs taken at events are only for use in editorial press publications (with correct crediting of the event). It is strictly forbidden to use these photographs for commercial purposes. Any other use must be discussed with the Event Organisers before the event. Failure to comply with these conditions may result in legal action.
5.5 CCTV and film cameras may be present at the events, this includes filming by the police or security staff carried out for the security of visitors, and filming and/or photography by Event Organisers. By purchasing a ticket to the Event and/or attending the event you give your express consent to all such filming and to your actual or simulated likeness being included within any film, photograph, audio and/or audio visual recording (“Footage”), all rights in which will be owned by Kelsey or the relevant third party. You also agree that any such Footage may be used by the Event Organiser in any and all media for any purpose at any time throughout the world, including (with the exception of CCTV or security Footage) for commercial purposes, without payment or compensation to you. 6.0 LIABILITY
6.1 Kelsey will not be liable for any loss, injury or damage, howsoever caused, to ticket holders or their property (“Loss”) except where and only to the extent that any such Loss is caused by the negligence of Kelsey Publishing Ltd, its employees or authorised agencies.
6.2 Any vehicles left at the venue for longer than the event day will be moved by the owners of the venue unless Kelsey have been advised and permission has been obtained. If vehicles are left overnight, it is the owner’s sole risk and Kelsey Publishing Ltd cannot accept liability.
6.3 Kelsey Publishing Ltd reserve the right to request ticket holders to leave the event at any time for safety reasons or immediately after the event. Re-admission will not be granted at the end of the event.
7.0 PROHIBITED ACTIVITES
7.1 Under no circumstances will auctioning, pitching, fundraising, raffles, tombola, canvassing or pick-a-ticket stands be allowed at the Event without the written permission of the Event Organisers.
7.2 The following are not allowed on the Event Site at any time: Animals; glass/bottles; bonfires; barbecues; drones, mini motos, trikes, bikes scooters or quads. Anyone found entering the event with what has been listed could be asked to leave.
8.0 CAR PARK TERMS AND CONDITIONS
8.1 All vehicles (and their contents) parked at the event are left at the owner’s sole risk. The Event Organiser shall not be liable for any loss or damage suffered by owners (including damage to owners’ vehicles and/or their contents), except where and only to the extent that such loss or damage is caused by the negligence of Kelsey Publishing Ltd, its employees or authorised agents. Kelsey Publishing Ltd reserves the right to move any vehicle it deems necessary due to logistical, safety or similar reasons.
8.2 It is a condition of admission to the venue that no animals are allowed within such areas and owners acknowledge that the Event Organisers personnel or their appointed contractor shall be entitled to enter any vehicle by whatever means necessary at the owner’s cost in the event that any animal has been left within a vehicle.
8.3 Owners and passengers alike must at all times act responsibly and with due regard to safety whilst in any of our event car parks (either on foot or whilst driving). The Event Organisers reserves the right to refuse admission and/or eject any person(s) found in breach of these conditions or the conditions of entry into the event.
9.0 UNFORESEEN EVENTS
9.1 Unforeseen Event means anything outside the reasonable control of Kelsey, including but not limited to, acts of God, adverse weather conditions, fire, storm, flood, earthquake, explosion, accident, acts of the public enemy, war, rebellion, insurrection, sabotage, epidemic, quarantine restriction, labour dispute, labour shortage, power shortage, ceasing to be entitled to access the internet for whatever reason, server crashes, deletion, corruption, loss or removal of data, transportation embargo, failure or delay in transportation, any act or omission (including laws, regulations, disapprovals or failures to approve) of any government or government agency.
9.2 If the Venue becomes unfit or unavailable for occupancy or shall be substantially interfered with by the occurrence of an Unforeseen Event and Kelsey decides, in good faith, that the Event cannot go ahead on the date stated in the Booking Form, then Kelsey’s obligation to perform in accordance with the Contract will be suspended and Kelsey shall decide, in good faith, whether the Event is to be cancelled, relocated or postponed to another date. Kelsey shall inform the ticket holder of such occurrence and its decision to cancel, relocate or postpone the Event as soon as practicable after the Unforeseen Event, and the ticket holder waives any claims it might have against Kelsey for refunds, damages or expenses. If Kelsey decides to relocate or postpone the Event it shall provide such details to the ticket holder within a reasonable period.
CLUB STAND TERMS AND CONDITIONS
IN ADDITION TO KELSEY PUBLISHING LIMITED’S STANDARD TICKET TERMS AND CONDITIONS, ANY CLUB MEMBERS SHALL BE SUBJECT TO THE FOLLOWING TERMS AND CONDITIONS AS STATED BELOW
1. The Event is organised by Kelsey Publishing Limited, subsequently referred to in these rules and conditions as the ‘Event Organisers.’
2. The term ‘Event’ shall refer to the event specified on the Booking page.
3. The terms ‘Showground’ and ‘Event Site’ shall refer to the place where the Event takes place as specified on the website.
4. The term ‘Stand Space’ shall refer to that specific area for the sole purpose of displaying the vehicles on as a part of a club stand as specified on the Booking page.
1.0 CLUB STAND OBLIGATIONS
1.1. The club stand shall be responsible for ensuring that all gazebos, marquees and other temporary structures are suitably secured on soft or hard ground.
1.2. If any gazebo, marquee or other temporary structure is deemed dangerous or unsafe by the Event Organisers or any appointed safety consultant then the item must be removed if the issue can’t be rectified and made safe.
1.3. All display material and/or exhibition equipment shall be positioned within the confines of the Stand Space.
1.4. No obscene material and/or display material and/or behaviour which could cause offence to visitors, other stands or the Event Organisers (and their staff and stewards) will be allowed.
1.5. All Club organisers must comply with all Health & Safety issues and legislation, and must return a completed Health and Safety Form with their completed Booking Form if they are using a marquee, gazebo or any other display material
1.6. Club organisers are responsible for the cleanliness of their Stand Space and all rubbish must be removed to the rubbish bins provided. The Event Organisers reserve the right to fine any club organiser who fails to do so an amount equal to the cost of cleaning the Stand Space and removing all rubbish.
1.7. Noise should be kept to a level such that it does not cause a disturbance to the Event Organisers or other Exhibitors or club stands
2.0 PROHIBITED ACTIVITIES
2.1. Under no circumstances will auctioning, pitching, fundraising, raffles, tombola or pick-a-ticket stands be allowed at the Event without the written permission of the Event Organisers.
2.2. Under no circumstances will any club stand be allowed to display and/or sell any products that is not part of their club merchandise.
2.3. The following are not allowed on the Event Site at any time: Animals; glass/bottles; bonfires; barbecues; drones, mini motos, trikes, bikes scooters or quads.
3.0 INSURANCES AND LIABILITY
3.1. The Event Organisers advise all club stands to take out adequate public liability insurance to cover their stand to protect them against claims by third parties, fire, damage and all other risks.
3.2. The club stand is liable for any damage, fire and any other risks that occur on their stand.
4.0 DISPLAY VEHICLES
4.1. All vehicles to be displayed on the Stand Space must have a club vehicle pass and must be placed within the confines of the area reserved for the Stand Space. Vehicles displayed outside the Stand Space will have to be moved by the Event Organisers to either the confines of the Stand Space or to the official car park.
4.2. All vehicles to be displayed which will be used for all or part of the display on Stand Space will be required to have a display vehicle pass.
4.3. All drivers of display vehicles will each require a car pass and a ticket.
5.0 CLUB STAND VEHICLE PASSES
5.0. Each club must have a minimum of 5 vehicle passes to qualify for a stand at the show.
Should this requirement not be met once the club deadline has been reached, the organisers will automatically move the orders from the aforementioned club stand to the special display area.
No refunds or discounts will be offered in this situation.
5.1. The car pass is for the vehicle and is non-transferable unless the Event Organisers are notified, and the vehicle details are updated in advance.
5.2. Vehicle passes must always be clearly displayed at the event.
5.3. Anyone without a car pass will have to park in the public car park.
54. Stand space is for pre booked clubs and exhibitors only.
6.0 UNFORESEEN EVENTS
6.1 If the Event Organiser(s) is unable to perform any of its obligations by reason of circumstance, cause or event outside of its control including (without limitation of the generality of this clause) any government restrictions, adverse weather, riot, commotion, act of God, industrial breakdown, breakdown of plant, any failure of gas waste services, electricity, or any traffic control and/or management issues etc, the Event Organiser(s) shall be entitled to be relieved of its obligations hereunder to the extent to which performance of the obligations is prevented, frustrated or suspended. In such circumstances non-performance, part performance or delay in performance of the obligations of the Event Organiser(s) hereunder shall not entitle the club stand and their members to claim damages or a refund of any kind whatsoever whether direct, indirect or consequential.
